That is why it isnt usually tied to the term. All other types of RMT are against the terms and participating in any way will get your account suspended. Also know you are dealing with criminals. It is reported very often that dealing with these people end in account theft to steal the stuff back and use your account to do even more harm. So feel very welcome to use the official gemstore. As you may guess, that can lead to Very Bad Things. Buying gems from ANet is different. Not only are you dealing with the company itself, but the game is built with a system that balances the gem<>gold transfer as part of the game. The more people use it to turn gems into gold, the further the rates shift to favor turning gold into gems. It works in the other direction too. But there are 3rd party sites that sell gold/items etc but you don't save much and risk account permanent ban. You might get maybe 15% cheaper prices but if caught (and I hear ANet catches these things within hours of it happening) you lose your account, however many dollars that is worth plus all your progress.
