No matter how transfer happens (mail, guildbanks, TP etc.), it depends on the situation: If the transfer is used to move gold between your own accounts, to gift/lend it to a friend, or to trade with another player, it would be legal. But if it happens because of RMT (goldselling) or to move gold from hacked accounts etc., it's illegal according to the ToS and the GW2 policies and the involved accounts may be sanctioned by anet. But as it's not easy to differ legal and illegal transfers, some legal ones may end as false positives and be sanctioned, or some illegal ones may be unpunished. For the second point with gw2efficiency: As this only manipulates some statistics on a 3rd-party site and doesn't influence the game itself, it's not necessary for anet to take actions in this case. The dev of gw2efficiency already changed the calculations of the acc-value some time ago, and it's not so easy anymore to manipulate it now.
